New York Cannabis Laws in 2026: What Every Visitor Needs to Know

The Marihuana Regulation and Taxation Act (MRTA) passed in March 2021, legalizing adult-use cannabis for anyone 21+. It also created the Office of Cannabis Management (OCM), which licenses retailers, growers, and processors and enforces the market.

The licensed retail market opened at the end of 2022. As of 2026, hundreds of licensed dispensaries and delivery operators are active across the state.

• In public: up to 3 ounces of flower or 24 grams of concentrate.
• At home: up to 5 pounds, stored securely.
• Under 21: possession is not legal. Penalties are civil for small amounts.

The core rule: anywhere you can legally smoke tobacco, you can smoke cannabis. That includes:

• Public sidewalks
• Most parks (subject to specific park rules)
• Private outdoor property with the owner's permission

What's off-limits:

• Inside vehicles (driver or passenger)
• On federal property (post offices, federal courthouses, national parks)
• School grounds and within 100 feet of a school entrance
• Workplaces with a smoking ban
• Indoor public spaces (bars, restaurants, hotel lobbies)

Most NYC hotels are non-smoking, including for cannabis. Some cannabis-friendly properties exist — call ahead. Vaporizers and edibles are the safest bet in a standard hotel room. If you smoke indoors and get caught, expect a cleaning fee.

Driving under the influence of cannabis is illegal in New York. Officers can arrest based on observed impairment. Because there is no reliable roadside cannabis breathalyzer, enforcement relies on field sobriety tests and Drug Recognition Experts.

It is also illegal to smoke inside a car — even parked, even if you're not driving. Store product in a sealed container in the trunk.

Airports and interstate transport are the biggest gotcha for visitors:

• TSA is federal. Cannabis is federally illegal. Do not fly with product.
• Crossing state lines by car, bus, or train violates federal law — even between two legal states.
• NY airports (JFK, LGA, EWR) all fall under federal jurisdiction inside the terminals.

One nuance worth knowing: per TSA's published policy, screening officers do not search for marijuana or other drugs — screening is focused on aviation security threats. But if cannabis is discovered incidentally during screening, the officer is required to refer the matter to law enforcement (Port Authority Police at JFK/LGA/EWR). Outcomes range from confiscation to a summons depending on quantity and circumstances.

Medical marijuana is treated the same. TSA does not recognize state medical cannabis programs — a New York medical card, an out-of-state card, or a doctor's note carry no federal weight. The only cannabis-derived products permitted through TSA screening are FDA-approved cannabinoid medications (e.g. Epidiolex) and hemp-derived products containing less than 0.3% THC on a dry-weight basis.

Legal NY cannabis carries a tax stack:

• 9% state cannabis excise
• 4% local cannabis excise
• Standard state and local sales tax

Prices on the menu are typically pre-tax. Anything from an unlicensed shop is untaxed and untested — the "deal" is why it costs less.

Adults 21+ can grow up to 3 mature and 3 immature plants each, capped at 6 mature and 6 immature per household. Growing is only for residents in a private residence — not for short-term visitors.
