Who can buy cannabis in New York

Anyone 21 or older with a valid government-issued photo ID can purchase cannabis in New York. Acceptable IDs include US driver's licenses, US passports, US military IDs, and non-US passports for international travelers.

No medical card is required for adult-use purchases. New York operates separate medical and adult-use programs.

Possession limits in New York

Adults 21+ can possess up to 3 ounces of cannabis flower and up to 24 grams of concentrate at any one time. These limits apply to what you can carry in public — possession at your private residence is unlimited.

Possession over the legal limit can result in fines or legal consequences. Stick to the limits and don't carry more than you need in public.

Where you can use cannabis in New York

Cannabis can be consumed on private property where smoking is permitted. Public consumption is generally allowed in places where tobacco smoking is allowed — but most parks, beaches, and outdoor public spaces prohibit smoking entirely.

You cannot consume cannabis in vehicles (driver or passenger), on federal property, in schools, or in workplaces. Most hotels prohibit cannabis smoking in rooms; edibles and vapes are typically tolerated.

Driving and cannabis in New York

Driving under the influence of cannabis is illegal in New York. Penalties are similar to alcohol DUIs. Never drive after consuming.

Open containers of cannabis — flower, edibles, or pre-rolls — should be kept sealed and in the trunk or otherwise inaccessible while in a vehicle. Treat cannabis the way you'd treat an open bottle of alcohol.

How cannabis delivery works in New York

Licensed dispensaries can deliver cannabis directly to adults 21+ at private addresses. The driver must verify a valid government ID in person. Delivery is currently available across all five boroughs and most of Long Island.

Purchase limits per visit

There are no strict per-purchase limits, but cumulative possession limits still apply. You can't purchase your way around the 3-ounce/24-gram possession cap.

Dispensaries track purchases through the state's seed-to-sale system. Repeated maximum purchases may trigger review under OCM rules.

Home cultivation in New York

Adults 21+ will be permitted to home-grow up to 6 plants (3 mature, 3 immature) per person, with a household cap of 12 plants. The OCM is finalizing rules; home growing for adult-use is not yet active statewide.

Medical cannabis patients have separate home cultivation rights under existing rules.
